Closing a Gun Sale ‘Loophole’

HARTFORD, Conn. (WTNH) — The gun sale loophole is something called ‘default sales.’ Several members of the Newtown Action Alliance, and other groups organized against gun violence, are joining the latest push for this change in the federal background check law. It was started yesterday, before the latest mass shooting in Oregon.

Like Miranda Pacchina of Sandy Hook who said today, “They will continue to create more Newtowns and Roseburgs and Auroras and Littletons and the list goes on and on.”

“We are quietly endorsing this mass slaughter by refusing to act in the face of mass shooting after mass shooting,” said Sen. Chris Murphy (D-Conn) in describing the U.S. Congress.

Both Connecticut U.S. Senators and Congresswoman Elizabeth Esty were at the State Capitol Friday to promote a proposed change in the federal law on background checks.

There is something called a ‘Default to Proceed’ loophole in the federal ‘Brady Handgun Violence Act’ that allows gun retailers to proceed with a gun sale if a purchaser’s background check hasn’t been completed in three days. Most background checks go through pretty quickly, but a delay can mean there are criminal records or other reasons why the gun purchaser should be denied.

Despite that, the sale can go through after 72 hours have passed. This proposal would eliminate that loophole.

“15,729 prohibited purchasers have acquired guns even though they have felony records or they’re drug addicts and otherwise prohibited by law,” said Sen. Richard Blumenthal (D-Conn) who also noted that’s how Dylann Roof, the shooter in the Charleston church mass murder was able to get a gun.

“No background check, no sale. No check, no gun…that’s the basic principle,” said Blumenthal.

In reaction to the shooting in Oregon, Scott Wilson, the head of the Connecticut Citizens Defense League,  the state’s largest gun owners rights group was arguing for more guns saying; “Whether anyone likes guns or not, it’s time to admit that gun free zones are not working. This is yet another gun free zone where (the latest) shooting occurred.”
